1. Scope

These Terms of Service govern the use of the mobile application "Gainz & Glory" (hereinafter "App") and the associated website gainzandglory.app. By using the App, you agree to these terms.

2. Service Description

Gainz & Glory is a fitness RPG app that transforms real workout data into in-game progress. The App is free to use.

• In-app purchases are currently not available but may be introduced in the future.
• Should in-app purchases be introduced, prices will be clearly displayed before purchase and processed through Apple's payment system.
• There is no obligation to purchase any paid content.

3. User Account

Registration is exclusively via "Sign in with Apple", which creates an anonymous, unique identifier.

• Each user may only operate one account.
• You are responsible for the security of your Apple account.
• You may delete your account and all associated data at any time within the App under "Profile". Deletion is immediate and irreversible.

4. Intellectual Property

All original content of the App — including but not limited to texts, game mechanics, code, and the overall concept — is protected by copyright and owned by the operator.

Certain visual assets (icons, illustrations) are used under commercial license from third-party creators. The respective copyrights remain with the original authors.

• Reproduction, distribution, or any other use without explicit written consent is prohibited.
• User-generated content (e.g., guild names, display names) must not infringe on the rights of third parties.

5. Disclaimer

Gainz & Glory is an entertainment app and does not constitute medical or health advice.

• Use of the App is at your own risk. Consult a physician before starting any exercise program.
• The operator is not liable for damages resulting from the use of the App, to the extent permitted by law.
• The operator does not guarantee uninterrupted availability of the App or its servers.
• Liability for slight negligence is excluded to the extent permitted by law. This does not apply to personal injury.

6. HealthKit Data

The App reads workout data from Apple HealthKit to calculate in-game progress. Health data is processed locally on your device and is never transmitted to our servers. Only aggregated values (total XP, level) are synced. See our Privacy Policy for details.

8. Governing Law & Jurisdiction

These terms are governed exclusively by the laws of Austria, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-law rules.

The exclusive jurisdiction for all disputes arising from or in connection with these terms is Vienna, Austria, to the extent permitted by law.

For consumers within the meaning of the Austrian Consumer Protection Act (KSchG), the statutory provisions on jurisdiction apply.

9. Final Provisions

• If any provision of these terms is or becomes invalid, the remaining provisions shall remain in full force and effect.
• The operator reserves the right to amend these terms at any time. The current version is always available at this URL.
• Users will be notified of significant changes through the App.
